DEL BOSQUE, MARTÍNEZ Y GARCÍA NARRO ABOGADOS, S.C. (hereinafter “BMG”), with domicile in Periférico Luis Echeverría Álvarez 443, Piso 05, Edificio Torrelit, Colonia Tecnológico, Código Postal 25280, Saltillo, Coahuila; in accordance with the terms of the Federal Law for Protection of Personal Information in Possession of Individuals (hereinafter the “Law”) and its Regulation, discloses that: BMG protects and safeguards your Personal Information to avoid damage, loss, destruction, theft, misplacement, alteration, or the unauthorized use of said information.
This Privacy Notice aims to inform the website’s visitors, current and former clients, former candidates and employees, friends and family of the members of BMG (hereinafter the “Users”), the processing, use, transmission, and transfer of the Personal Information shared with BMG, as well as the exercise each User has to their entitled ARCO rights (Access, Rectification, Cancellation, and Opposition), or to revoke the consent and the right to limit the use or disclosure of the Personal Information previously granted to BMG.
For what purposes do we collect and use your Personal Information?
The collection, use, storage, as well as the access, management, advantage, transmission, or disposition (hereinafter the “Processing”) we have for the Personal Information of the Users, has the following purposes:
Provide the requested services;
The sending of information, newsletters, application of satisfaction surveys of our services, notifications related with our services, the sending of documents and call services;
Supply information and quotes of our services;
Comply with contractual obligations assumed with our clients, such as: acceptance and processing of payments, prepare invoices, register in the database of BMG clients, and
Maintain our facilities and infrastructure secure through our systems of prevention, detection, and video surveillance, in order to verify the compliance of the internal policies of the Law, and secure the normalcy and safety of BMG and the people within its facilities.
In the collection and processing of the Personal Information, we comply with all of the principles stated in the Law and its Regulation: lawfulness, quality, consent, information, purpose limitation, loyalty, proportionality, and responsibility.
What information do we obtain from you?
The Personal Information that BMG could collect from you could be the following:
a) Identification information: Information that allows your distinction from other individuals. This data may include: name, Tax Registration Number (RFC), Unique Population Registration Code (CURP), date of birth, nationality, sex, gender, official documents issued by the government such as passport, driver’s license, birth or marriage certificate, professional identification card, among others;
b) Contact information: Information that allows BMG to keep in touch with you. This data may include: domicile, particular, landline or mobile phone number, email, username data of social media with the purpose of reaching out to you (for instance, through the inbox of your Facebook, Twitter, Instagram, Foursquare, or Swarm and Google + account);
c) Employment information: Information regarding an individual’s employment, position, or commission, such as: position, employment domicile, institutional email, institutional phone;
d) Property and Financial Information: Information regarding an individual’s assets, rights, charges or obligations, and expenses subject of economic valuation such as: personal and real property, tax information, credit history, income and expenses, bank accounts, insurance, guarantees, among others;
e) Electronic registers: This information includes (i) certain data from you or your device which is obtained when you access our Digital Properties, and (ii) the registry of images and/or voice obtained through our video surveillance systems, which are obtained when you visit our facilities, and
f) Any other information you choose to provide us by virtue of our relation and interaction.
From where do we obtain your Personal Information?
BMG may obtain your Personal Information through different forms:
a) Personally from you: when you personally provide your information in our office;
b) Through communication media: For instance, when you provide us your information by telephone, electronic media such as email or social media, or when your image or voice is captured by our video surveillance services. Likewise, when we obtain information from you automatically through Cookies, Web Beacons or other tracking technologies, either directly or from a third party (Please consult the “Cookies” section established on this Notice), and
c) Through other sources: We may obtain information from you through other sources including:
Information we may collect from third parties: This information includes additional geographical information contact, the foregoing in the terms of the applicable national laws;
Information other clients may provide from you. Our policies demand that the client that provides information regarding another person, informs that person about our policies of collection, use, and storage of information before providing their Personal Information and to obtain from that person their express consent, previous such transmission, and
Other sources of public access.
Transmission of the collected Personal Information
Transmission of Personal Information to third parties. BMG may transfer your Personal Information to third parties for the established purposes on this Notice. These transmissions are made as long as considered necessary for the maintenance or compliance of the legal and service relationship between BMG and you, consequently, your information may be shared or transferred to a third party in some cases:
We only transfer your information when we have your consent, or in case your consent is not necessary for the transmission, in accordance with the established terms on Article 37 of the Law;
You specifically accept the transmission of your information to third parties in the following cases: (i) when your information has to be transferred to any Public Notary or Firm, for the purposes of any requested service; (ii) when BMG has to transfer the information to the competent authorities in charge of the law enforcement when requested by a court order; (iii) when your information has to be transferred to a third party that is jointly involved in the provision of services that you requested or when BMG hires a third party to provide the necessary services for the proper performance, aiming an execution of a comprehensive service to the User; (iv) when the information requires to be transferred to a third party in the context of a corporate transmission (including mergers, or acquisitions, among others). In this latter case, the companies that may receive your information are potential acquirers and advisors (legal, accountants, or financial, among others) in connection with the transaction and we will only inform your Personal Information to such third parties as long as such information is necessary to evaluate or complete the transaction, and
Likewise, the data may be transferred to national or foreign third parties that BMG hires to provide the necessary services for the proper performance, aiming for the execution of a comprehensive service to the User.
Control and security measures we use for the protection of the collected Personal Information
BMG establishes administrative, technique, and physical security measures to protect your Personal Information, the same that we demand the providers of services that we hire to comply.
Every data and Personal Information that you provide us by using our services will constitute a database property of BMG. The information will be stored in order to protect, avoid damage, loss, misplacement, or alteration of said information.
How to stop receiving notifications
To stop receiving notifications from our website, you can cancel your subscription at any time by sending an email to info@bmgabogados.com appointing the matter as “Cancel Subscription”.
How to exercise your ARCO rights and revoke the previously granted consent
As Personal Information Owner, you can exercise the ARCO rights (Access, Rectification, Cancellation and Opposition to the processing of Personal Information), or revoke the consent that you previously granted to BMG for the processing of your Personal Information, (i) through the email account info@bmgabogados.com; (ii) directly attending to our offices; or (iii) requesting it by independent writing, by sending it to the domicile located in Periférico Luis Echeverría Álvarez 443, Piso 05, Edificio Torrelit, Colonia Tecnológico, Código Postal 25280, Saltillo, Coahuila, addressed to “Personal Information Service”, indicating your name, complete domicile, official documentation accrediting your identity, appointing the relationship with BMG and specifying on a fair and non-misleading basis the Personal Information from which the access, rectification, updating, cancellation and opposition is requested, as well as indicating the reasons why you consider that your information should be updated, rectified or cancelled. As of reception, the Personal Information Service Department will have a term of twenty (20) natural days to respond to your request, however, such term could be extended by the same time period, in that case, you will be notified by the same form you previously indicated us for such purposes, appointing the reasons of said extension, in accordance with Article 32 of the Law.
Likewise, we inform you that in terms of the Law and its Regulation, you may begin with the procedure of the Protection of ARCO Rights before the Mexican National Institute for Transparency, Access to Information and Protection of Personal Data (INAI), within the next fifteen (15) days as of the date that BMG responds to your request and said response is not of your satisfaction, or if concluded the appointed term BMG does not give a response to your request.
In order to receive a timely and satisfactory response to your requirements and necessities, the User guarantees that the Personal Information provided to BMG is truthful, consequently, the User is responsible to communicate to BMG any modification of said information.
Modifications to the Privacy Notice
We reserve the right to change this Privacy Notice at any time.
In case that any change is made to this Privacy Notice, you will be informed through our website http://bmgabogados.com. Every change made to our Privacy Notice shall enter into force on the following day of the publication of the new version on our website.
